Terms of Service

TERMS OF SERVICE

These Terms set out the conditions for using the Weather XRPL DePIN service (wellbian.io, the "Service") provided by Wellbian Labs Pte. Ltd. (a Singapore company, the "Company"). By signing up for or using the Service, you are deemed to have agreed to these Terms.

Article 1 (Purpose)

The purpose of these Terms is to define the rights and obligations between the Company and users regarding the use of the air quality data DePIN network operated by the Company - device registration, license NFT issuance, telemetry collection, quality validation, WLBN reward payment, data API and data bounties, and DeFi integration.

Article 2 (Definitions)

  1. "WLBN": a utility token (issued asset) issued by the Company on the XRP Ledger (XRPL)
  2. "License NFT": an XLS-20 standard NFT proving device ownership
  3. "Station": a device registered with the Service that transmits air quality data, and its operator
  4. "Easy Wallet": a non-custodial embedded wallet created with an ID/password or a social account
  5. "Partner": KWeather Co., Ltd. (KWeather, a Republic of Korea company)

Article 3 (Operator and Responsibility Structure)

  1. The operator of the Service is Wellbian Labs Pte. Ltd., a Singapore company.
  2. The issuance, burning, and circulation management of the WLBN token, and the design of the reward policy (budget, distribution, quality criteria), together with ultimate responsibility for them, belong exclusively to the Company (the Singapore entity). This applies regardless of any delegation of operations under Article 4.
  3. The Company manages the WLBN issuing and operating accounts on the XRPL, and holds the authority and responsibility to change the tokenomics (fixed budget, halving, burn policy, etc.).

Article 4 (Partnership and Delegation of Korean Operations)

  1. The Partner (KWeather) is the Company's partner responsible for supplying the air quality measurement devices used in the Service (such as the ARC-600DA), quality certification, and device-related technical support.
  2. All Service-related operations performed within the Republic of Korea - device distribution and sales, installation and after-sales service, domestic customer support, domestic marketing, etc. - are delegated by the Company to the Partner.
  3. Notwithstanding the delegation in the preceding paragraph, in accordance with Article 3(2), all authority and responsibility for issuing the coin (WLBN) and designing the reward policy are not subject to delegation and remain reserved to the Company (the Singapore entity). The Partner holds no decision-making authority regarding token issuance or reward policy.
  4. Warranties for defects in the device itself follow the device purchase contract and the Partner's warranty policy.

Article 5 (Accounts and Wallets)

  1. Users may sign up for and log in to the Service with an ID/password, a social account (such as Google), or an external XRPL wallet.
  2. The Easy Wallet is non-custodial: wallet keys are generated and encrypted in the user's browser, and the Company cannot decrypt them. If you lose your password (or seed), the Company cannot recover your wallet, and any resulting loss of assets is borne by the user.
  3. Transferring, selling, or lending accounts or IDs is prohibited.
  4. One redeem code can be registered to only one wallet, and account activation support (XRP) is provided once, only to the wallet that initiated device registration.

Article 6 (Service Description)

  1. A license NFT is issued when a device redeem code is registered, and only stations holding the NFT in their wallet are eligible for rewards.
  2. Data transmitted by a station undergoes daily quality validation (uptime, outliers, neighbor correlation, calibration), and rewards accrue the following day.
  3. Accrued rewards are paid on-chain upon the user's claim.
  4. De-identified data may be provided to third parties via the API and data bounties (Article 9).

Article 7 (Nature of the WLBN Token)

  1. WLBN is a utility token used for rewards and payments within the Service, and is not equity, a security, a deposit, or legal tender.
  2. The market price of WLBN may fluctuate, and the Company does not guarantee any price. Nothing in the Service constitutes investment solicitation.
  3. The Company operates its issuance, burn, and budget policies in accordance with the whitepaper and Service notices, and announces policy changes within the Service.

Article 8 (User Obligations and Prohibited Conduct)

  1. Transmitting false or manipulated data (software-only transmission without a device, data duplication, replay, etc.) is prohibited.
  2. Based on integrity validation (flatline and duplication detection, etc.), the Company may refuse or claw back rewards from fraudulent stations and suspend the device.
  3. Attacks on the Service or API, exploitation of vulnerabilities, and misappropriation of others' accounts are prohibited and may incur liability under applicable law.

Article 9 (Data Collection and Use)

  1. Air quality telemetry transmitted by stations is used for Service operation, quality validation, and reward calculation.
  2. When provided to third parties, individual station identifiers are de-identified (pseudonymization, aggregation, k-anonymity).
  3. Participation in data bounties and receipt of sponsor marketing are subject to the user's individual consent (opt-in) and may be withdrawn at any time.
  4. Registered email addresses are used only for notices and recovery guidance.

Article 10 (Service Changes and Suspension)

The Company may change or suspend all or part of the Service as operationally or technically necessary, and material changes will be announced in advance. The Company is not liable for delays or losses caused by circumstances beyond its control, such as failures or forks of the blockchain (XRPL) itself.

Article 11 (Disclaimer)

  1. Blockchain transactions are irreversible, and losses caused by the user's mistyped addresses or signing errors are the user's responsibility.
  2. External wallets (D'CENT, Xaman, GemWallet, etc.) are services of their respective providers, and the Company is not liable for their failures or losses.
  3. To the maximum extent permitted by applicable law, the Company's liability is limited to direct damages and capped at the amount the user paid to the Service in the most recent three months.

Article 12 (Governing Law and Dispute Resolution)

These Terms are governed by the laws of the Republic of Singapore. Disputes arising in connection with the Service shall first be resolved through mutual consultation; if unresolved, they shall be finally settled by arbitration under the arbitration rules of the Singapore International Arbitration Centre (SIAC). The seat of arbitration shall be Singapore, and the language of arbitration shall be English.

Article 13 (Amendments and Language)

  1. The Company may amend these Terms; amended Terms will be announced within the Service at least 7 days before the effective date (30 days for changes unfavorable to users).
  2. These Terms are written in Korean; in case of any discrepancy with a translation, the Korean version prevails.
